They set out the legally binding terms on which Silversaga Patterns / Silversaga SARL (“we”, “us”, “our”) supplies (a) PDF sewing‑pattern files made available for instant download (“Digital Patterns”) and (b) physical fabric and related goods (“Goods”) to consumers purchasing through our online shop hosted on the Shopify platform (the “Site”).
Nothing in these Terms limits the mandatory rights that consumers enjoy under European Union or French law. In the event of any conflict between these Terms and such mandatory rights, the latter will prevail.

2. Scope
------------------------------------------------------------
These Terms apply to every contract concluded between you and us via the Site. By placing an order you accept these Terms.

3. Products
------------------------------------------------------------
3.1 DIGITAL PATTERNS. Digital Patterns are supplied as PDF files for personal, non‑commercial sewing only. See clause 10 for licence details.
3.2 GOODS. Goods descriptions (fibre composition, width, weight and care instructions) comply with Regulation EU 1007/2011 (textile labelling). Colours may vary slightly from on‑screen images.

4. Prices and payment
------------------------------------------------------------
Digital Patterns.
Prices are set in euros and include VAT (or a comparable sales tax) at the rate applicable in your country of residence within the European Union, under the EU one-stop-shop (OSS) rules for digital services.
Fabric and other Goods.
Prices include French VAT at the applicable rate.
If you are located outside the EU, no VAT is charged by us; your local customs authorities may levy import duties or taxes, which are your responsibility.
Delivery charges, if any, are displayed separately before checkout. We accept the payment methods shown on the Site at the time of ordering.

5. Order process

(a) By completing the checkout you make a binding offer to purchase.
(b) The contract is formed when we send you an order‑confirmation email.
(c) We reserve the right to refuse an order, for example if stock is unavailable or payment cannot be authorised.

6. Right of withdrawal (cooling‑off period)
------------------------------------------------------------
6.1 GOODS (fabric etc.).
Right of withdrawal applies only to Goods that are not cut or customised to your specifications. Ready‑packaged items can be returned within 14 days from the day after delivery. Fabric cut to your chosen length is considered “made to the consumer’s specifications” (Article 16 (c) CRD) and is therefore exempt from the withdrawal right. To exercise your right for eligible Goods, inform us by email or use the model withdrawal form in Annex 1. You must return the Goods within 14 days of notifying withdrawal and bear the direct cost of return. We will refund all payments received, including the original standard delivery cost, within 14 days of receiving the returned Goods or proof of return.
6.2 DIGITAL PATTERNS.
When you purchase Digital Patterns you are asked to tick a box giving (a) your express consent to immediate supply and (b) acknowledgement that you thereby lose the right of withdrawal under Article 16 (m) of Directive 2011/83/EU. If you do not provide this consent you will not be able to download until the 14‑day period expires.

7. Delivery of Goods

7.1 We deliver to the countries indicated on the Site. Estimated delivery times are displayed at checkout.
7.2 Risk and title. Risk of loss or damage passes to you only when the Goods are delivered to you (Article 20 CRD). Title passes on full payment.

8. Supply of Digital Patterns
------------------------------------------------------------
Digital Patterns are made available for download immediately after the contract is formed (subject to clause 6.2). We will provide any updates necessary to keep the Digital Patterns in conformity with the contract for a reasonable period, in accordance with Directive (EU) 2019/770 and Article L224‑25‑6 Consumer Code.

9. Legal guarantees
------------------------------------------------------------
9.1 Guarantee of conformity (goods). Goods benefit from the legal guarantee of conformity for two years as per Articles L217‑3 to L217‑20 Consumer Code.
9.2 Guarantee of conformity (digital content). Digital Patterns must conform for two years from supply; during that period you are entitled to bring them into conformity without charge.
9.3 Latent defects. You also benefit from the guarantee against hidden defects (Articles 1641 ff Civil Code).
A summary of your key rights is reproduced in Annex 2.

10. Intellectual property and licence

10.1 All intellectual‑property rights in the Digital Patterns and the Site are owned by or licensed to us.
10.2 Personal‑use licence. Upon purchase we grant you a non‑exclusive, perpetual licence to:
(a) download and store the PDF file on your personal devices;
(b) print unlimited copies for your own private, non‑commercial sewing.
You may not redistribute, resell, upload to file‑sharing sites or use the Digital Patterns for commercial production without prior written permission. You may not sell finished garments. You can gift garments as long as you purchase one pattern per gifted garment.

11. Prohibited uses

You agree not to use the Site or Digital Patterns for any unlawful purpose, nor to infringe our IP rights or those of third parties.

12. Limitation of liability
------------------------------------------------------------
Nothing in these Terms excludes or limits liability for (i) death or personal injury caused by negligence, (ii) fraud, or (iii) any liability that cannot be limited under applicable consumer law. Subject thereto, we are liable only for foreseeable loss or damage arising from our breach of contract or statutory duty, and in no event for business losses, loss of profit or indirect damages.

13. Indemnity

If you breach these Terms or applicable law and this causes us loss, you agree to indemnify us for reasonable damages, costs and expenses actually incurred. This clause does not apply where you are a consumer resident in the EU if and insofar as it would be considered an unfair term.

14. Personal data

Processing of personal data is governed by our Privacy Policy, which complies with Regulation (EU) 2016/679 (“GDPR”). The Privacy Policy forms part of these Terms.

15. Third‑party services
------------------------------------------------------------
Our store is hosted by Shopify Inc. Their Terms of Service and Privacy Policy apply to your use of the Shopify platform features.

16. Governing law and jurisdiction

These Terms are governed by French law. You may bring proceedings before the competent court of your place of residence or of [COMPANY LEGAL NAME]’s registered seat.

17. Alternative dispute resolution

In accordance with Article 14 of Regulation (EC) 524/2013, you can access the European Commission’s Online Dispute Resolution (ODR) platform via https://ec.europa.eu/consumers/odr. We are not obliged and do not undertake to use ADR entities to resolve consumer disputes.

We may amend these Terms from time to time. The version displayed on the Site at the time of your order will apply to that order.

Annex 2. Summary of French consumer rights
------------------------------------------------------------
1. Legal guarantee of conformity for Goods - two years from delivery to obtain repair or replacement (or refund if repair/replacement impossible).
2. Legal guarantee of conformity for digital content - two years from supply to obtain conformity or price reduction/refund.
3. Guarantee against hidden defects - you may act within two years of discovering the defect and obtain refund or reduction.
